BUCCLEUCH ESTATES LIMITED ESKDALE & LIDDESDALE ESTATE CONDITIONS OF LET OF FISHINGS ON IRVINE HOUSE BEATS
DESCRIPTION Irvine House Mid Beat (Party 1) Right bank only from the top of the Carrot Bed to the junction with the Tarras Water, a distance of about 283m, and both banks, but mainly fished from the right bank, from the junction of the Tarras Water to Stone End Pool, a distance of about 658m. Irvine House Lower Beat (Party 2) Both banks from Flatts to the top of Blue Clints, a distance of about 1280m.
RODS AND DURATION Each party is for a maximum of three individual rods for the duration shown on the attached schedules. For the avoidance of doubt, it is not acceptable that more than three people should share the daily allocation of three rods.
SHARING OF THE WATER Rods are expected to treat other rods fishing the beat with great consideration and to move down the water taking a minimum of one step cast. When fishing a single bank, rods should not enter the water directly in front of those fishing the opposite bank but enter upstream. Should the person opposite fail to move down then the rod may proceed downstream. Those fishing Tarras Flat are advised that fish often lie close to the side and wading should be restricted to the rivers edge to avoid disturbance. In the event of beats remaining unlet, the Estate reserves the right to let to individual rods by the day. At all times the Estate reserves the right to permit one extra rod to fish any beat for the purpose of catching fish to be supplied to The Duke of Buccleuch.
RESTRICTIONS Tenants will comply with all legal requirements including the By-Laws made by the Environment Agency affecting the River Esk in Scotland. Rod Licences are not generally required in Scotland, however the Environment Agency state that it will enforce an English/Welsh type Rod Licence on as much of the Border Esk and its tributaries as are situated in Scotland as from 1 April 2005.
SEASONS Salmon 1st April to 31st October Sea Trout 1st April to 30th September
CONSERVATION Sea Trout A bag limit of 2 Sea Trout maximum may be taken in any one day or nights fishing. Thereafter catch and release will apply. In the light of Sea Trout numbers returning over the last few years, you are strongly urged to use additional restraint and take no more than you really need to eat. All Sea Trout over 3lbs will be returned. Most will be hen fish and the need to optimize on egg deposition is paramount. New byelaws also demand that any Hen Sea Trout caught after 9th September each season also be returned. Salmon It is a legal requirement on the Border Esk and Liddle that all salmon caught before 16th June must be released. Also after 9th September each season all Hen Salmon will be returned alive. A maximum of 2 salmon may be taken in any one day. Please use good conservation practice and take only what you reasonably need to eat. Fishing will be carried out in a sportsmanlike manner. The use of shrimps and prawns is prohibited; if any member of a fishing party is found to be using shrimps or prawns, any illegal method or undesirable conduct, then all further fishing for the party will cease immediately without compensation or refund of rent. Dogs must be kept under proper control and, if requested by the Bailiffs, tethered or removed. No fishing lure may be used which contains more than one treble hook. Gyrodactulus Balaris and infectious diseases of Fish:- All fishers must take reasonable precautions to prevent possible transfer of disease by disinfecting tackle/waders etc which have been exposed to waters outside the UK and Eire. ACCESS Rods must use authorised car parks and paths.
FISHING HUTS WEEKLY LETS Huts will be unlocked ready for guests and keys left within for guests use and retention during the week. Guests are invited to go direct to the Beats. At the end of the fishing week guests may leave keys in the catch return book or return them to Peter Kinstrey. Should a fishing party decide to leave earlier than the end of the week then the Estate would ask you to notify Peter Kinstrey of this arrangement.
GHILLIE There is no permanent Ghillie on the private beats.
RECORDS In each fishing hut there is a sheet for recording the numbers and weights of fish caught. Tenants are required to fully complete this sheet ON A DAILY BASIS.
HEALTH AND SAFETY ACT The Buccleuch Estates Ltd. accept no responsibility for injury or loss incurred by rod holders or damage caused to vehicles, fishing tackle or other property belonging to the rod holders or other fishers arising from the let. Anglers are particularly warned of the dangers of electric fencing erected by local farmers. All rods must accept the risk incidental to the exercise of the right of fishing thereby conferred, and will have no claims against The Buccleuch Group for any injury, loss or damage suffered by them in consequence thereof. Weak and non swimmers are advised to wear a buoyancy aid.
