1. The rent payable at the time of booking is as set down in the permit along with appropriate amount of VAT
2. The Tenant should carry the booking confirmation at all times while on the riverbank and in the event of the Tenant inviting guests to fish, they must be provided with an authorisation in writing stating the name and address of the third party and the dates on which they are permitted to fish. Anyone found fishing without adequate written permission will be in breach of Section 1 of the Salmon and Fresh Water Fisheries Protection Act 1951 and may be prosecuted.
3. The permission extended by these Conditions of Let comprise the right only to fish for salmon and sea trout and the Estate accepts no responsibility for natural hazards or adverse climatic conditions. Any person exercising the fishings by virtue of these Conditions of Let does so at his or her own risk and all Tenants are advised to maintain suitable third party liability insurance cover to indemnify themselves and all guests against whatever claims may arise from the exercise of the fishings let. Life jackets are available in each hut.
4. The fishings let in terms of these Conditions of Let will be exercised in a fair and sportsmanlike manner and by fly only and the exercise thereof will at all times comply with the provisions of the Salmon and Fresh Water Fisheries Protection Act 1951. In particular, and without prejudice to the foregoing generality, the following are expressly prohibited:- Spinning Worming The use of natural or dyed prawns or shrimps or any other bait.
5. There will be returned to the water unless badly damaged during capture, all red salmon and hen fish ripe with spawn, any fish which may have been foul hooked and any fish of less than 9 inches in length and the same shall be returned carefully to the water.
6. Tenants and those permitted to fish by virtue of these Condition of Let will report immediately to Police Scotland, or the Superintendant of the Esk District Salmon Fisheries Board, any suspected poaching incident or the fishing by unauthorised persons on the beats hereby let.
7. Any dogs brought to the river and not kept under control will be put on a lead by the estate ghillie or Airlie Estate gamekeeper,
8. The countryside code shall be observed at all times, no fires should be lit and no litter may be left in and around the riverbanks or fishing huts. Tenants and those deriving permission from them must exercise care and consideration in driving vehicles over private access roads leading to the river.
9. It shall be the option of the Airlie Estates acting through their fishing ghillie or Factor to bring an end without notice any let of fishings in the event that these Conditions of Let are breached.
10 All tenants will inform the Estate Office of all fish caught, by naming the pools, the fly and the size of fly. A note of any fish caught, kept or returned to the water will be included in the appropriate term.
